00 [Music] Welcome back to another awesome episode of the Careful Boys. We got Alex with us. Hey, uh, >> Mr. Aosta. >> What's up, man? What's up, man? Hey, you, uh, you're now that Diddy has technically not or still technically waiting for some version of punishment, but he got acquitted on certain things. Mhm. >> He's actually counter suing and filing a $100 million defamation lawsuit against Courtney Burgess Burgess. >> Who's Courtney Burgess? >> She I think is basically Let me see. >> Is she like a p like a someone a defendant for the the state or something? Is she a publication? >> Actually, well, okay. >> Specifically speaking, >> yeah, you guys. Specifically, Combmes filed a $und00 million defamation
50 lawsuit against NBC Universal, Peacock TV, and Ample Entertainment. The lawsuit alleges that the documentary Diddy the Making of a Bad Boy made false and defamatory statements against him and that he doubled the defamation damages he was seeking in a separate legal filing uh towards Courtney Burgess uh attorney Ariel Mitchell and News Nation's parent company Nextar as defendants seeking damages for alleged false statements made about Comb's supposed involvement in sex parties with celebrities and underage individuals. So >> imagine he wins, >> right? Well, you have to prove that the statements being made are true. >> That's hard to do. I mean, he could win possibly, right? Cuz he got off on a lot of ████ >> cuz it's just a game. Like the legal system isn't really like who's really right or wrong. It's just a game that you play. >> The best lawyers. >> Well, defamation um cases, you quite
41 literally have to prove that whatever you were saying publicly can be proven to be true. >> So, like you better have some sort of records >> or something. >> Yeah. >> That can back up your statements. Otherwise, >> hard. Yeah, >> defamation court cases are really difficult >> cuz I I didn't really look too deeply into it, but I think the last thing that I read was um I think the court ruling that technically all the victims were all consenting adults. >> And then so they're like all those crazy like what we think are like grape cases aren't really grape. They they wanted to be there. They asked for the drugs themselves. They're all adults. No one's underage. So technically they don't have uh all the main juicy stuff that we want to pin on him >> aren't Yeah. It's not >> It's really tough. >> Yeah. So he might win all these cases.
33 >> Yeah. He was found not guilty of raketeering conspiracy and sex trafficking but guilty of two counts of transportation to engage in prostitution. >> So yeah, like cuz he would hire like male prostitutes, female prostitutes. >> Right. But that is that is interesting if like it is probably as simple as the person who said I forced them. I had video of them not resisting kind of a thing. So then that proves kind of like what happened to uh >> right >> a a Mandrew mate. >> Oh yeah. >> He's counter suing the the he's suing the uh because I know that one's an algo killer for sure. But the um but the uh the woman who had accused him >> uh now that he has proof that she was like coerced and like offered something in exchange of doing that, he's suing
23 the ████ out of her. >> Yeah. That that lawsuit alleges that the woman and her parents conspired to falsely imprison them by providing fabricated evidence to Romanian authorities. The woman identifies as Janeo is also facing legal action in Romania where she's accused the mates of similar offenses. Yeah, >> that was transactional is what you're saying. >> I think he can prove it now. Okay. He can prove that like uh like she was offered something in order to to make that story. >> Got it. Because if it's transactional, there's still consent even if it's not legal. >> Oh, >> no. I think the transaction is on her end receiving. >> Oh, no. That's what I'm saying. >> Yeah. Yeah. For for >> to make up a story. Yeah. To make >> Okay, never mind. >> He's saying it never happened and that she created it as a way to take him down. someone else wanted to take him down and went, "Hey, say this happened. >> Here's an angle coming in."
14 >> Okay. >> Yeah. But I guess he has proof that he can show in court that that wasn't the case. >> Which that that is the craziest thing though, right? Because like we've kind of touched upon this thing before like was the baseball player, right? Who got his >> Oh my god. He lost his deal and everything over a girl that's Oh my Yeah, that's horrible. >> That hurts. >> Yeah, he comes in. >> He lives He lives down the street and he always comes in. Yeah, it's really funny. >> Yeah, this random dog just comes in. Yeah, >> but not not saying who is or isn't or guilty or taking sides with anybody, but the idea of like being accused of something that like really changes the course of your life or your your you know public image or whatever and then it proves in some way, shape or form either uh not fully true, untrue or whatever. Like that's that's damaging.
05 >> Yeah. Well, that's defamation. 100% you should sue for that. >> The hardest part though is that a lot of the time in in common situations when that happens like let's say that happened to you by some girl, right? There's just no money you can get from that person. They're not you're not always the victim of a rich guy. You know what I mean? Like it's it's so hard to counter sue the person that's so much far below you in net worth. >> Yeah. >> So it's like a weird thing. >> I know like my my buddy had that happen to when he was in high school. I've told the story before, but it's the craziest save of a lifetime. In high school, he got with this girl who uh I guess she cheated on her boyfriend to hook up with him, and then afterwards, she told everybody that that he had forced her. And then uh the um he had to go to court. And then um when they were doing the deposition or whatever, he's like,
56 "I actually have something I could do to prove that I didn't do it." And um they were like, "What?" And he goes, "I actually recorded it the whole time, >> but he didn't tell her." >> So is that like getting off on a bigger crime, but now you have a lesser crime that you >> Didn't you use that before even though she >> wasn't consenting to being filmed? Cuz like isn't there filming an audio? >> Well, the thing is that >> parameters when it comes to >> I don't know exactly. I don't I don't think anything came of that part. That might have had to be a different case, but it exonerated him from the crime completely. But the crazy thing is he said, so he was in high school still. They're both, I think, underage. And they had to like review the tape to make sure that they had to watch it from
46 beginning to end to make sure she never says don't, >> no, stop. That's crazy. >> Yeah. He said it was really ████ embarrassing. Like you got to sit there. You watch it with like these adults and >> both sides of the case have to see it. The girl didn't know it existed. >> Oh my. >> And I guess like she just they just dropped they threw it out, but she didn't sue for the for filming it or nothing. It was just kind of exposed that she was like lying. Yeah. >> And I guess he was the reason it got that far into court is cuz he wasn't telling anyone he filmed it for the longest time cuz he was scared he'd get in trouble. >> But if that was the only way to save him, he's like, "Okay, I'm going to confess. I did I did do this." >> And they they got out. And then so that guy uh like I traveled with him tons of different countries and every time he hooks up with someone he he films it for that reason >> without them knowing
37 >> he has like a thing now >> he has like almost like a phobia where like he won't even do it unless it's being filmed. >> It's like I can't get it up unless I set up my GoPro over there. >> Yeah. And I used to think that he was just saying that cuz I didn't know the story for years. I was just like oh this fool likes to film it. You're a freak, dude. >> I was like, you freaky guy. And then like him and his brother told me like, "Oh, you know where that started, right?" And I was like, "What the ████ >> That's crazy." >> Nah, dude. That was a trip to find that out. And I'm like, "Okay, I get it now." And then he was also telling us, "You guys should start doing that, too." I was like, I don't think I'll run into that problem, but all right. >> So, he just has ████ >> like a terabyte. >> Yeah. Archives of him. >> He absolutely does. I don't know if he delet he's now he's like committed to one woman. So, I I think he probably did the right thing and got rid of it, but he kept everything, like everything. In
29 the case that years down the line, someone goes, "That's the guy that, you know, did this to me," >> then he has nothing but a fun-filled hour of footage of them >> and it's uh Yeah. immediately exonerated. >> That's crazy. >> Yeah. It's It's nuts that you kind of have to do that in a way. not like be sneaky about it, but uh >> like if I was that chick in high school, as soon as I hear him call that out and I know that he didn't do that, I would just be like, "Ah, we don't got to watch it. I dropped the case >> so we don't have to like go through some high school, too." >> Yeah. >> Yeah. So then after that, he he didn't do it sneakily ever again, but on tour, he would tell girls like, "Is it cool if I film?" like just even a little bit just to like get that covered so that they know that he filmed it in their head and they can't
20 >> Can I just film the part that I come? Yeah, it was a weird like I never I was kind of new to that world of having to like think of that and I was just like >> I'm curious like what if the video is so short that you can't prove >> if she ever said no or stop >> cuz I think the point is that they know in their mind that you recorded something so it's enough to deter them if they want to lie about it. >> So it's like preventative. >> Yeah. But then if you really did do it after that then they should get in trouble. Like just like piggybacking off like Bart's joke, like if he only filmed the end portion. >> Yeah, that would be very bad. >> Then you don't know >> for certain. >> I'm sure that if he actually did it and it's the part that's not on camera, then they could argue that and they would probably, you know, win. But I just don't think it gets that far. They don't they don't scheme that way. If they know
10 that there's a little bit more evidence then, you know, won't be so easy as like saying, "Oh, he did it and then I was helpless." You know what I mean, >> right? cuz there are a lot of factors that they look at like there's there's some stuff like another friend of mine had something happen to them similar and they had to analyze like oh there's a video of you guys of you walking her out after and she's smiling and it's happy and and and you hug him and kiss him and you go in the cab like little details there they are going to look at that it doesn't prove that nothing happened >> but it is enough to kind of support the case before it gets to court >> I get that >> where the deposition looks everything how many women pretend to be happy and smile in order to prove yourself to survive and then that backfires on them because now it looks consensual. >> Yeah. Yeah. Yeah. That's the thing too. It's hard to prove either way. But I think when once everyone's looking at
00 all the evidence before like it goes to court, you can judge there on if you have a case or not. And >> for most people like your lawyer might say we've got a case or he might say I don't know how to >> Well, your lawyer's job is to be have the best possible debate. >> Yeah. >> So they're going to find any angle. But it's crazy that some lawyers will straight up tell the woman even if it really did happen. Like it's just not worth the time and trouble. Like you should just start healing from here. Go to therapy. You know, when going through this case will just take another year and a half of your life that you'll just have to think about it. Your name will be in the record. Like there's so many weird ways to deter them from like going through with it, >> which is like really messed up. >> But yeah, that is true. You could really like you could really uh think you covered all your bases and then it's still like bad. >> Yeah,
50 >> that's unfortunate. I know it is unfortunate.
